These Terms and Conditions (“Agreement”) govern the use of Enrichment Services Program’s SMS messaging services for conversational messages intended for meeting and event notifications through our hosted platform. By accessing or using Enrichment Services Program’s SMS messaging services for these purposes, you (“User”) agree to comply with these Terms and Conditions, along with all applicable laws and regulations.
1. Introduction
Enrichment Services Program allows Users to send SMS messages for conversational purposes, including but not limited to meeting reminders, event notifications, and other relevant communications. The following Terms and Conditions govern the User’s use of SMS messaging through the hosted platform.
2. Scope of SMS Usage
By opting in to receive SMS communications from Enrichment Services Program, Inc., you agree to receive conversational messages related to our services. Message frequency may vary. On average, 1-2 messages per month.
Message and data rates may apply. Please check with your mobile carrier for details regarding your plan and any applicable charges.

3. Compliance with Legal Requirements
You agree to use Enrichment Services Program’s SMS services in full compliance with all applicable laws, including but not limited to:

- CAN-SPAM Act
- General Data Protection Regulation (GDPR)
- Federal Communications Commission (FCC) Regulations
- State-Specific Privacy and Consumer Protection Laws
Failure to comply with these regulations may result in suspension or termination of your account.

- You must honor all opt-out requests promptly and ensure that recipients who opt-out do not receive further messages from you.
- It is your responsibility to keep an up-to-date list of recipients who have opted out.

2. Opt-Out Instructions:

5. Message Content
You agree that the content of your SMS messages will meet the following guidelines:
- Meeting/Event Notifications: The messages must relate strictly to meeting reminders, event updates, schedule changes, or other relevant notifications pertaining to meetings or events that the recipient is registered for or has expressed interest in.
- No Spam or Unsolicited Messages: You agree not to send any unsolicited or irrelevant messages to recipients. All messages must be of value and directly related to the specific event or meeting.
- Prohibited Content: You may not send messages that:
- Violate any applicable laws or regulations.
- Are misleading, deceptive, or fraudulent.
- Include offensive, abusive, or harmful content.
- Include spam or unsolicited marketing messages.
- Clear Information: Each SMS message should clearly state who is sending it and what the recipient can expect (e.g., event reminder, meeting schedule update).
6. Message Frequency and Limits
You agree that the frequency of the conversational messages sent will be limited to a few times per month for each recipient. These messages must be related to meetings or events that the recipient is registered for or has explicitly expressed interest in attending.
Sending messages too frequently or sending irrelevant content could result in recipients opting out or flagging your messages as spam, which could lead to penalties or suspension of your account.
7. Data Privacy and Security
- You are responsible for ensuring that any personal data collected from recipients (such as phone numbers) is handled in compliance with all applicable privacy laws, including but not limited to the GDPR, California Consumer Privacy Act (CCPA), and other relevant data protection laws.
- Enrichment Services Program will handle recipient data in accordance with our Privacy Policy and will not use recipient data for any purposes other than to provide the SMS messaging service.
- You agree to take appropriate measures to secure and protect any personal data you collect through SMS messaging, including the use of encryption and secure storage practices.
8. Account Suspension and Termination
Enrichment Services Program reserves the right to suspend or terminate your access to the SMS messaging platform if it is determined that you have violated these Terms and Conditions, including sending unsolicited or non-compliant messages. In such cases, Enrichment Services Program may also report the violation to relevant authorities.
- Suspension: If your account is suspended, you may not use the SMS messaging service until the issue has been resolved and your account is reinstated.
- Termination: Enrichment Services Program reserves the right to terminate your account permanently if a serious violation occurs.
9. Indemnification
You agree to indemnify, defend, and hold harmless Enrichment Services Program, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from or related to your use of the SMS messaging service, including but not limited to violations of these Terms and Conditions or applicable laws.
10. Limitation of Liability
Enrichment Services Program will not be held liable for any damages arising from the use or inability to use the SMS messaging service, including but not limited to delays, failures, or undelivered messages. Our liability is limited to the amount you have paid for the SMS services in the 12 months preceding the incident.
11. Changes to Terms and Conditions
Enrichment Services Program reserves the right to modify or update these Terms and Conditions at any time. You will be notified of any significant changes, and continued use of the service constitutes acceptance of those changes.
